*********, a biotech company headquartered in Utah using AI to discover treatments in a wide variety of therapeutic areas, including rare diseases, engaged Mergenthaler, a moving company, to move a number of office and laboratory items, including fragile items, to its new headquarters in October of 2018. Mergenthaler and ********* agreed that Mergenthaler would wrap and protect fragile items adequately during the move. During the move, ********* was shocked to witness several Mergenthaler employees consuming alcohol during their services for ********* and immediately notified Mergenthaler of the issue. In addition to its employment of individuals under the influence of alcohol, Mergenthaler failed to adequately wrap and protect fragile equipment as agreed upon. Due to the use of alcohol and/or the failure to adequately wrap the equipment, a number of items were damaged, including items essential to *********'s operations. When the damage was identified, Michael H******* of Mergenthaler, speaking on behalf of Mergenthaler, apologized and assured ********* that Mergenthaler would take care of it. As instructed by Mergenthaler, ********* immediately set about replacing and repairing the items to avoid further disruption to its operations, and filed a claim with the insurance company that Mergenthaler engaged to insure the value of the move. After collecting information from both ********* and Mergenthaler, the insurer denied the claim. ********* asked Mergenthaler to assist in addressing this with the insurer, and Mergenthaler refused. Mergenthaler also refused to provide the insurance policy or any other information to ********* to assist ********* in disputing the insurer's denial. ********* now seeks monetary compensation of approximately $37,000 directly from Mergenthaler for the damaged items.
